Landlord Alleged to Defend Self in Bronx Tenant's Beating Death

The Fatal Confrontation in Throgs Neck

Initial Incident and 911 Call

Cops responded to a frantic 911 call around 6:10 p.m. on Saturday and found Kristopher Samaroo, 30, with blunt force trauma outside his Throgs Neck home. The circumstances surrounding his death are complex and involve his landlord, Omar Lamoni, 43, and his brother Edwin Nina, 39. They were charged with assaulting Samaroo and his fiancée, Brittney Shears, 31.According to the criminal complaint, Samaroo was holding their 6-month-old daughter when Nina hit him, almost causing the child to be struck by Nina's closed fist. Lamoni and Nina then allegedly continued to kick and punch Samaroo in the head and body after he handed the infant to Shears.

The Use of the Baseball Bat

Nina is said to have repeatedly struck Samaroo about the body with a baseball bat outside the house on the Throgs Neck Expressway near Barkley Ave. The charges may be upgraded after the autopsy results for Samaroo are revealed. Assistant Bronx District Attorney Patrick Watts stated that as a result of their conduct, one of the victims sustained serious physical injuries and was declared deceased at a Bronx hospital. The autopsy results are pending, and the People may choose to elevate the charges to higher-level felony charges, including homicide charges.Shears also suffered injuries to her face, neck, and body from both Lamoni and Nina. The video played in court showed Nina reach into the back of his truck, pull out a baseball bat, run back up the stairs of the building, and swing at Samaroo. It also showed a continuous series of fights between the landlord, his brother, and the couple for more than 12 minutes, ending with Samaroo collapsing on the steps to the building before he made it inside.

The Legal Battle and Different Perspectives

Lawyers for Lamoni and Nina claim that Samaroo likely suffered a heart attack during the fracas and that he and his fiancée were the ones who started the showdown outside the Throgs Neck duplex. They argue that the video will show that they did not strike Samaroo with any weapons and that Mr. Lamoni was attacked by the deceased and his wife.However, Samaroo's fiancée told News12 Bronx that the victim was severely beaten by their landlord and his brother. Shears said that [the landlord's brother] went to the trunk of his car, grabbed a steel bat, ran up the steps to the front of her house, and started attacking her husband. She also mentioned that her family had been dealing with issues such as no hot water for months and partial rent withholding.According to Housing Court papers, Lamoni had served the couple with eviction papers in September. But in May, Samaroo and Shears filed a suit alleging housing violations and harassment. A report from the city Housing Preservation and Development Department showed that the couple had no hot water, a leaking roof, and missing smoke detectors.
